Terms of Service

1. Who we are and these terms

These Terms of Service ("Terms") apply to fuzzycon.com (the "Site"), FuzzyCon events, and orders placed through the FuzzyCon Card Shop. The Site is operated by FuzzyCon ("FuzzyCon," "we," "us"). You can reach us at fuzzy@fuzzycon.com.

By using the Site, sending a form, or placing an order request, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Site. You must be at least 18 years old to place an order or submit a form.

2. Brands and community content

FuzzyCon is a community-run event and site. Fuzzycards, Fuzzybear and related names, artwork and card designs belong to their respective owners, including the Fuzzycards publisher. Their use on the Site identifies the products we sell and the community we serve and does not mean the owners endorse or operate FuzzyCon unless we say so. Links to other sites (such as Luma, X, Telegram, xrp.cafe and card shops) are provided for convenience. We do not control those sites and are not responsible for their content, terms or practices.

3. FuzzyCon Card Shop: retailer orders

Who can order

The FuzzyCon Card Shop currently sells sealed booster boxes to retailers and resellers. We may ask for business details and may decline any order at our discretion.

Order requests

When you submit the order form you receive an order number (for example, FC-1001). This is an order request. It is not an offer we have accepted and it does not reserve stock. We will reply by email with a wholesale quote and payment instructions, usually within one business day.

Minimums, pricing and availability

• The minimum order is 2 boxes. We may set a maximum per order.
• The manufacturer's suggested retail price (MSRP) shown on the Site, currently $220 per box, is for reference only. Your wholesale price is the price stated in your quote.
• Quotes are valid for the period stated in the quote (or 7 days if none is stated) and are subject to availability. Prices are in US dollars and exclude taxes, duties and shipping unless the quote says otherwise.
• If we made an obvious pricing or listing error, we may correct it before your order is accepted.

Acceptance, payment and fulfillment

An order is accepted and becomes a binding contract only when you pay the quoted amount through the official Fuzzycards order portal and that payment is confirmed. Payment, invoicing, shipping and delivery are handled through that portal and its production and shipping partners, whose terms also apply to the transaction. Products ship from the production facility. Delivery dates are estimates. Depending on your country, import duties, taxes or customs fees may apply on delivery and are your responsibility.

Cancellations, damage and returns

• You can cancel an order request at any time before payment by replying to our quote email.
• If a shipment arrives damaged, incomplete or wrong, email us within 7 days of delivery with your order number and photos of the packaging and product. We will work with the fulfillment partner to replace, refund or credit the affected items.
• Because these are sealed collectible products, opened or unsealed boxes cannot be returned, and we do not accept returns for change of mind after payment unless required by law.

4. About the products

Fuzzycards booster boxes contain 24 sealed booster packs of 5 randomized cards each. Contents are random. Individual cards cannot be chosen, duplicates are possible, and no specific card, rarity or "pull" is guaranteed. Cards and boxes are collector's items for ages 18 and up and are not toys. Any statements about rarity, collectability or value are not promises about future value or resale price.

5. Your responsibilities as a reseller

If you resell products bought from us, you are responsible for your own business licenses, resale certificates, sales taxes, product listings, consumer disclosures (including the 18+ and random-contents notices) and compliance with the laws where you sell. You may not imply that you are FuzzyCon or the Fuzzycards publisher, or that they endorse your business.

6. Events

FuzzyCon events may require RSVP through a third-party service, a minimum age (FuzzyCon I is 21+) and photo ID. Capacity is limited and entry is first come, first served. We may change event details, refuse entry or remove anyone whose behavior is unsafe or disruptive. Giveaways, promo cards and merch are offered while supplies last.

7. Forms and messages

When you use the "Join the Fuzzy Team" form or the order form, you agree that the information you give is accurate and that you are allowed to share it. Sending a form does not create a job, partnership, sponsorship or any other agreement. Those exist only if we confirm them in writing.

8. Acceptable use

You agree not to misuse the Site. That includes sending spam or automated submissions, trying to get around the security check, probing or attacking the Site or its servers, scraping it in a way that harms its operation, impersonating others, or using it for anything unlawful.

9. Site content

The Site's text, layout and original images are owned by FuzzyCon or its licensors and may not be copied for commercial use without permission. Third-party marks and artwork remain the property of their owners.

10. Disclaimers

The Site and its content are provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement, except any warranties that cannot be excluded under applicable law. Nothing on the Site is financial or investment advice, including anything about digital assets, NFTs or the XRP Ledger.

11. Limitation of liability

To the fullest extent permitted by law, FuzzyCon will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data. Our total liability for any claim relating to the Site or an order will not exceed the amount you paid for the order that gave rise to the claim, or $100 if the claim does not relate to an order. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.

12. Indemnity

You agree to defend and indemnify FuzzyCon against claims, losses and costs (including reasonable attorneys' fees) arising from your misuse of the Site, your breach of these Terms, or your resale of products, except to the extent caused by our own wrongdoing.

13. Governing law and disputes

These Terms are governed by the laws of the State of Georgia, USA, without regard to its conflict-of-law rules. Before filing a claim, you agree to email us and try to resolve the dispute informally for at least 30 days. Any claim that is not resolved will be brought exclusively in the state or federal courts located in Fulton County, Georgia, and you and FuzzyCon consent to their jurisdiction. Either party may bring an individual claim in small claims court if it qualifies.

14. Changes

We may update these Terms from time to time. We will change the effective date above when we do. Changes apply to use of the Site and order requests submitted after the update is posted.
